We are committed to protecting and respecting your privacy. This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

2 INFORMATION WE MAY COLLECT FROM YOU

2.1 We may collect and process the following data about You:
2.1.1 when You provide or upload any information to the Beta Test Service or the Service, Voxeo will store such information for the purpose of providing the Beta Test Service or the Service;
2.1.2 if You contact Voxeo, we may keep a record of that correspondence;
2.1.3 we may also ask You to complete surveys that we use for research purposes, although You do not have to respond to them;
2.1.4 details of Your visits to the Website or use of the Beta Test Service or the Service including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own purposes and the resources that You access; and
2.1.5 details of Your instant messenger account name, caller ID and contents of files uploaded and stored with Voxeo.

3 IP ADDRESSES AND COOKIES

3.1 We may collect information about Your computer, including where available Your IP address, operating system and browser type, for system administration and to report aggregate information. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.
3.2 For the same reason, we may obtain information about Your general internet usage by using a cookie file which is stored on the hard drive of Your computer. Cookies contain information that is transferred to Your computer's hard drive. They help us to improve the Website and the Beta Test Service or the Service and to deliver a better and more personalised service. They enable us:
3.2.1 to estimate our user base size and usage patterns;
3.2.2 to store information about Your preferences, and so allow us to customise the Website and Beta Test Service or the Service according to Your individual interests;
3.2.3 to speed up Your searches; and
3.2.4 to recognise You when You return to the Website.
3.3 You may refuse to accept cookies by activating the setting on Your browser which allows You to refuse the setting of cookies. However, if you select this setting You may be unable to access certain parts of the Website. 4 WHERE WE STORE YOUR PERSONAL DATA

4.1 All information You provide to us is stored on our secure servers.
4.2 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect Your personal data, we cannot guarantee the security of Your data transmitted to the Beta Test Service or the Service; any transmission is at Your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

5 USES MADE OF THE INFORMATION

5.1 We will use the information held about You to:
5.1.1 ensure that content from the Website is presented in the most effective manner for You and for Your computer; and
5.1.2 notify You about changes to our Beta Test Service or the Service and Website.

6 DISCLOSURE OF YOUR INFORMATION

6.1 We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006.

6.2.1 in the event that we sell or buy any business or assets, in which case we may disclose Your personal data to the prospective seller or buyer of such business or assets;
6.2.2 if Voxeo Europe Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets; or
6.2.3 if we are under a duty to disclose or share Your personal data in order to comply with any legal obligation, or in order to enforce or apply these terms and other agreements; or to protect the rights, property, or safety of Voxeo Europe Limited, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection, age and identity verification.
6.3 You have the right to ask us not to process your personal data for marketing purposes. We will usually inform You (before collecting Your data) if we intend to use Your data for such purposes or if we intend to disclose Your information to any third party for such purposes. You can exercise Your right to prevent such processing by not using the Website or the Beta Test Service or the Service.
6.4 The Act gives you the right to access information held about You. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing You with details of the information we hold about You.

7 UPLOADING INFORMATION

7.1 Whenever You make use of a feature that allows You to upload information to the Beta Test Service or the Service or Website, or to make contact with other registered users of the Beta Test Service or the Service, You must comply with the Content Standards set out in the Terms. You warrant that any such contribution does comply with those standards, and You indemnify us for any breach of that warranty.
7.2 In providing or uploading information to the Beta Test Service or the Service or Website You grant us the right to use, copy, distribute and disclose to third parties any such information for the purposes set out in these terms.
7.3 If at any time You wish to leave the Beta Test Service or the Service, You can notify using the following email address. On receiving Your notification, we will remove from our Beta Test Service or the Service all information provided by You. We reserve the right to retain copies of any information that You provide for record keeping purposes and compliance with our legal obligations.
7.4 We also have the right to disclose Your identity to any third party who is claiming that any material posted or uploaded by You to our Beta Test Service or the Service constitutes a violation of their intellectual property rights, or of their right to privacy.
7.5 We will not be responsible, or liable to any third party, for the content or accuracy information provided or uploaded to the Website or Beta Test Service or the Service by You or any other user of the Website or Beta Test Service or the Service.
7.6 We have the right to remove any information You provide or upload to the Beta Test Service or the Service if, in our opinion, such material does not comply with our acceptable use requirements set out in the Terms.
7.7 You will be truthful and accurate in any information that you provide or upload to the Beta Test Service or the Service or Website.
